The balance is due on or before receipt of puppy. If the dog must be shipped, costs of crate and shipping charges and any other necessary costs will be that of the Purchaser. SELLER AGREES TO: Guarantee that the puppy is in good health with all necessary vaccinations for its age for up to 72hrs. If said dog is found to be ill, attributable to seller within 72hrs, as diagnosed by a Veterinarian. Said dog may be returned, with Veterinarian statement, for a full refund. Guarantee said dog be free of hip dysplasia up to 25mths of age, as determined by the Orthopedic Foundation for Animals. Should there be an assumption other than by OFA of hip dysplasia, a hip x-ray must be read by a certified radiologist and the reading results must be submitted in writing by the certified radiologist to Seller. If found worse than "Fair", Seller agrees to replace said dog with one of equal value from the first available litter at Sellers Discretion after receipt of written proof of spay/neuter of said dog. Final hip x-rays for OFA must be done no later than 60days after said dog’s two-year birthday to be guaranteed by this contract. Guarantee said dog to pass eye certification for Progressive Retinal Atrophy (PRA) up to 24mths of age, as determined by a certified ophthalmologist. Seller reserves the right to have a second Veterinarian (of Sellers choice) to have an evaluation of dogs condition before honoring guarantees. PURCHASER AGREES TO: Take said dog to a Veterinarian within 72hrs from time of purchase for a health examination. To give Nu Vet Plus Canine Supplement for the first 2yrs of puppies life or something comparable (supplement purchaser wishes to use other than the Nu Vet should be submitted to breeder to determine if supplement is adequate for the growth of said puppy, and breeder must approve new supplement for guarantees to remain in place) . After 2yrs of age buyer may discontinue use although we highly praise this product and suggest you continue it. A sample and brochure will be sent home in the puppy packet as well as a buyer code needed to purchase the supplement. All information will be handed to new owner on how to purchase the product. This is a MANDATORY Clause and NO EXCEPTIONS will be made. Nu Vet product is both tested and used in our kennel, and is helpful with all aspects of a puppies Health, Growth, and Development. NOT USING THIS PRODUCT OR BREEDER APPROVED SUPPLEMENT CAUSES GUARANTEES TO BECOME NULL AND VOID ! Keep said dog up to date on all vaccinations needed throughout the dogs life. We do not use the Lepto Vaccine. Said dog will not be used for any breeding, and to have said dog spayed/neutered at 9mths of age and to provide written proof to Seller at time of spay/neuter. Registration papers shall be provided upon the Purchaser supplying Seller with a veterinarian's letter as proof of spay/neuter by 9 months of age. At the time Seller receives proof of spay/neuter by a licensed veterinarian, Seller shall immediately relinquish AKC registration papers to said purchaser. The seller has determined that the puppy/dog is of "pet quality" and is NOT suitable for breeding/showing or has decided to place a show potential pup within a companion home. Please understand that a companion puppy does not make the puppy of lesser quality just that said puppy does not have the traits/qualities that the breeder is looking for to be a representative of the breeders kennel in the conformation ring. It is understood by all parties that said puppy is being sold as a "companion" puppy and will not be allowed to reproduce at any time in the future. It is also agreed by all parties that said puppy will be sold on limited registration and that AKC papers will be held until such time as proof of spay/neuter is given. * Limited registration as defined by AKC *: Litters produced by said dog are not eligible for AKC registration. Said dog is eligible to compete in all AKC-licensed events except breed competition at an AKC-licensed dog show. *WE RESERVE THE RIGHT TO REPOSESS/SEIZE ANY DOG THAT HAS BEEN ACCIDENTALLY OR DEEMED NON-ACCIDENTALLY BRED* SAID DOG WILL NOT BE USED FOR ANY FIGHTING PURPOSES. Maintain dog in a healthy environment at all times, Ex: adequate food and water, exercise, kenneling, medical care, and proper living conditions to achieve full genetic potential, as defined by normal moral values. Agrees to keep dog in their home with a properly fenced in yard or in a kennel with proper shelter. At no time is dog to be chained and left, allowed to roam free or raised on tile floors or floors of equivalent slick texture. Recognizing that proper footing is very important to skeletal development. Purchaser will use extreme caution for the skeletal development of said dog up to one year of age by refraining said dog from horseplay, jumping off high places and rough playing with other dogs. Agrees to feed a premium dog food. Said dog has been eating PRO PLAN LARGE BREED PUPPY. Agrees to socialize said dog around people and other animals. To attend obedience courses (which means said dog is trained by purchaser or spouse etc. with the help and guidance of a obedience instructor which is usually done in a group around other owners with puppies of the same age) and provide proof of said dog passed. Ex: Certificate of Graduation provided from the obedience school. If Purchaser wishes to do the training without attending courses, a program in which the purchaser intends to follow must be immediately submitted for reviewal! Purchaser agrees to have said dog under control at all times. Agrees to have said dog crate trained and trained to be comfortable in a kennel/run as this will help dog to adjust to strange situations, such as boarding, flying or any stressful event. Lack of training and socialization on Purchasers part does not constitute poor breeding on Sellers part. Agrees to notify Seller of any serious illness or death of said dog. Agrees to notify Seller of any moves, providing new address and phone number, as this is required knowledge of Seller to maintain good standings with the American Kennel Club. Agrees to give Seller 30 day notification of intention to sell dog, and give the first right refusal or repurchasing of said dog at an agreed upon price, but not more than original purchase price. If for some reason in said dogs life, Purchaser is not able to keep said dog due to unforeseen circumstances, Seller will do their best to help place said dog in a new home or take said dog back, if Seller has space, at no cost to the Seller, providing the dog has been properly trained in all areas as stated in this contract. It will be at the Sellers Discretion to take dog back if it has bitten someone, not crate trained, kennel trained, or has a questionable temperament. If for any reason said dog is returned to Seller, it will be at the Purchasers expense to return said dog and sign over AKC Registration papers. Agrees that said dog *AND OFFSPRING IF APPLICABLE* will NOT be sold to any pet store, dog dealers, research laboratories, pet shelters, guard dog business or any other wholesale party. If said dog is sold to another party, Purchaser must notify Seller of whom the new owner will be and where the dog will live. The new owner must agree to the terms of this contract also.! Agrees to carry the prefix name "AK" in the first part of the dogs registered name. An "s" may be added at the end of "AK". EX: AK's Bright Light "Star" NOT LIKE THIS Bright Light AK's "star" <------- PLEASE do not do this as it is a breach of contract. Seller is not responsible for said dog if it has suffered neglect, mistreatment or exhibits temperament faults, which are the result of lack of training or abuse by the purchaser. In addition, Seller is not responsible for any damages or bodily harm either directly or indirectly caused by said dog. Seller and Purchaser agree that it is hard to calculate damages should a breach of contract be made. If Purchaser makes a breach in contract Purchaser will pay Seller the original cost of said dog as well as $3,000. In addition to the surrender of the said dog, as well as any legal fees accumulated and associated in the enforcement of this agreement. Seller and Purchaser agree that this amount of liquidated damages is fair and is no way deemed punitive in any respect. Seller and Purchaser agree that the law of the State of New York shall apply to this contract/agreement and that this contract/agreement shall be enforceable in Saratoga Springs, NY. The undersigned have read and understood the terms of this sales contract, and agree to the terms and conditions set forth herein.
